Terms of Service

Effective: May 8, 2026

These Terms govern the conditions, procedures, and rights and obligations between LINKSUP, Inc. (the "Company") and its members in relation to the SEACHING service (the "Service").

Article 1. Purpose

These Terms set forth the matters concerning the use of the Company's seafood import/export trade data analysis service. By using the Service, members are deemed to have agreed to these Terms.

Article 2. Definitions

The definitions of terms used in these Terms are as follows: · "Company": LINKSUP, Inc. · "Service": The SEACHING platform and all functions provided through it (seafood trade analytics, price forecasts, company discovery, AI chatbot, etc.) · "Member": A person who has agreed to these Terms and completed registration · "Non-member": A person who uses part of the Service without registration · "Content": All information provided through the Service, including data, analytics, AI outputs, text, and images Terms not defined herein shall be governed by applicable laws and service guidelines.

Article 3. Effect and Amendment of Terms

These Terms take effect when a member consents to them upon registration and are posted within the Service. The Company may amend these Terms within the scope permitted by the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and other applicable laws. When amending the Terms, the Company shall post notice within the Service at least 7 days before the effective date, specifying the effective date and reasons for the change. For amendments adverse to members, at least 30 days' advance notice shall be given, with individual notification by email or other means. Members who do not agree to the amended Terms may discontinue use and withdraw. Continued use of the Service after the effective date of the amended Terms shall be deemed acceptance of the changes.

Article 4. Scope of Service

The Company processes public data sources, including Korea Customs Service trade statistics, to provide the following services: · Seafood trade information analysis and market trends · Price forecasts and statistical data · Company discovery and comparison · AI chatbot assistant · Other services developed or offered through partnerships The Service is provided for informational purposes only and does not constitute a guarantee, recommendation, or basis for any trade, investment, or contractual decision. The Service is available 24 hours a day, year-round, in principle. However, temporary interruptions may occur due to scheduled maintenance, system updates, or unforeseen technical issues.

Article 5. Registration and Account Management

Registration is conducted through email/password signup, OTP verification, Google OAuth, or other authentication methods supported by the Company, and includes an email verification process. The Company may refuse registration or terminate an account in any of the following cases: · Registration using another person's information · False information provided during registration · Registration for purposes that undermine public order or morals · Failure to meet other registration requirements set by the Company Members are responsible for maintaining the security of their account and must immediately notify the Company upon discovering unauthorized use. Liability for failure to report rests with the member. Account sharing, multi-account abuse to circumvent policies, and automated account operations are prohibited.

Article 6. Member Obligations

Members shall not engage in any of the following activities in connection with the Service: · Bulk data collection using automated means (crawlers, scrapers, bots, etc.) · Circumventing API rate limits or creating multiple accounts to bypass restrictions · Commercial resale, redistribution, or reprocessing of Service data · Unauthorized use of data for AI model training, fine-tuning, or building derivative datasets · Publishing or citing data externally without crediting the Company as the source · Any activity that interferes with the normal operation of the Service · Registering false information or misappropriating another person's information · Defaming or causing disadvantage to others · Hacking, distributing computer viruses, or attacking information systems · Engaging in commercial activities using the Service without prior consent of the Company · Any other activity in violation of applicable laws In case of violation, the Company may immediately restrict or suspend service use without prior notice and may pursue civil and criminal legal action.

Article 7. Company Obligations

The Company shall not engage in activities prohibited by applicable laws and these Terms or contrary to public morals, and shall endeavor to provide the Service continuously and reliably. The Company shall not disclose or distribute a member's personal information to third parties without the member's consent, except as required by applicable laws. If temporary suspension of the Service is necessary, the Company shall post notice within the Service at least one week in advance. In urgent or unavoidable circumstances, notice may be given after the fact. The Company shall endeavor to process member complaints and feedback promptly. When immediate resolution is not possible, the Company shall inform the member of the reason and expected timeline.

Article 8. Intellectual Property

Intellectual property rights and other rights related to Content, data analytics, AI outputs, software, designs, logos, and service names included in the Service belong to the Company. Members may not copy, reproduce, modify, translate, publish, broadcast, or otherwise use or provide to third parties any information obtained through the Service without the Company's express authorization. Members may not transfer, donate, or pledge as collateral their right to use the Service or any other contractual status.

Article 9. Source and Nature of Information

① The Service collects and analyzes publicly available government data, including Korea Customs Service trade statistics and Ministry of Food and Drug Safety (MFDS) import food declaration data. ② Members acknowledge that information provided by the Service is generated based on public data disclosed pursuant to the Act on Provision and Use of Public Data. ③ Trade relationship information (e.g., importer-exporter matching) provided by the Service is a statistical estimate based on public data and may differ from actual business relationships. ④ There may be time lags due to the update cycles of source data; Korea Customs data is updated monthly and MFDS data is updated daily.

Article 10. Information Non-Deletion Principle

① Information provided by the Service is based on data publicly disclosed by government agencies pursuant to applicable laws; therefore, requests for deletion of information by specific companies or individuals are not accepted in principle. ② However, the Company shall take prompt action upon verification in the following cases: · Clearly erroneous data in the source (upon submission of supporting evidence) · Exposure of personal information in violation of the Personal Information Protection Act · Data that has been corrected or deleted by the source agency ③ Requests under paragraph 2 shall be submitted through the 'Data Error' category on the contact board, and the Company shall provide the results within 10 business days from the date of receipt.

Article 11. Disclaimer

The Company does not guarantee the accuracy, completeness, or timeliness of the data provided. Data is sourced and processed from external sources such as Korea Customs Service, and errors, omissions, or update lags in the original data may occur. Members must independently verify data before using it for decision-making. The Company shall not be liable for any direct or indirect damages (including business losses, investment losses, trade disputes, etc.) arising from the use of the Service. AI-based forecasts, analyses, and recommendations are estimates and do not guarantee future outcomes. The Company shall not be liable for damages caused by force majeure events such as natural disasters, war, network outages, or third-party service disruptions beyond its reasonable control.

Article 12. Damages and Legal Action

The Company shall not be liable for damages incurred by members in connection with services provided free of charge, except in cases of willful misconduct or gross negligence on the part of the Company. The Company shall not be liable for service disruptions caused by the member's own fault. The Company may pursue all available legal remedies against members who violate these Terms, including damages claims, criminal complaints, injunctions, and unjust enrichment claims. Members are required to preserve evidence of violations and cooperate with the Company's investigations, and shall be liable for damages caused to the Company or third parties by their breach.

Article 13. Service Modification, Suspension, and Termination

The Company may modify, suspend, or discontinue the Service for reasonable operational or technical reasons and shall provide reasonable advance notice when feasible. For permanent discontinuation, at least one month's advance notice shall be given. Members may withdraw at any time through the account deletion feature in My Page. Upon withdrawal, member data shall be destroyed without delay, except where retention is required by applicable laws. For dormant members who have not used the Service for an extended period, the Company may restrict service use after providing notice and a one-week grace period. If the Company is unable to provide normal service, it may temporarily suspend the Service, and the Company shall not be liable for any loss of data being stored or transmitted during such period.

Article 14. Beta Period Notice

The Service is currently offered free of charge during the open beta period. Paid plans may be introduced after the beta ends; the Company will notify members in advance of any changes. During the beta period, data accuracy, feature stability, and service availability may be limited.

Article 15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any dispute arising between the Company and a member in connection with the Service shall be brought before the Busan District Court as the agreed-upon court of jurisdiction.

Supplementary Provisions

These Terms shall take effect on May 8, 2026. Matters not specified in these Terms shall be governed by the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, and other applicable laws. These Terms also apply to members who registered prior to the effective date.
